Marketing Consulting Services
Cultivate Marketing & Consulting provides personalized marketing consulting and related services for small and local businesses. Potential services may include:
- Marketing strategy and consulting
- Vendor review and consolidation guidance
- Google Ads
- Google Local Services Ads
- Social media advertising
- Social media posting
- Content writing
- CRM and GoHighLevel consulting
- Marketing automation and integration
- Marketing performance review
- Other agreed-upon marketing support
Cultivate does not use a universal, one-size-fits-all service package. The services, scope, responsibilities, deliverables, pricing, and timeline for each client are determined after consultation and should be documented in a separate proposal, service agreement, statement of work, invoice, or other written agreement.
If a separate signed agreement conflicts with these general website Terms, the separate agreement will control for the applicable paid services.
No Guarantee of Results
Marketing performance can be influenced by many factors outside Cultivate’s control, including market conditions, competition, advertising budgets, platform policies, website performance, pricing and offers, client response times, sales processes, customer demand, third-party systems, and changes made by advertising or technology platforms.
Cultivate may provide strategy, recommendations, implementation, management, or support, but does not guarantee specific revenue, profit, leads, patients, customers, appointments, rankings, advertising performance, return on investment, or business growth. Examples, estimates, projections, and prior results are not promises of future performance.
Client Responsibilities
When services are purchased under a separate agreement, the client may be responsible for providing accurate and timely information, supplying required content, approvals, and access, reviewing work and responding within agreed timelines, maintaining sufficient advertising or platform budgets, complying with industry-specific laws and professional requirements, securing necessary rights to supplied images, text, trademarks, and other materials, protecting account credentials, and paying third-party platform charges and advertising spend unless otherwise agreed. Specific responsibilities should be documented in the applicable service agreement.
Consultations
Cultivate may offer complimentary business consultations, including 45-minute Zoom calls, to discuss a prospective client’s business, goals, current marketing, questions, ideas, or concerns.
A complimentary consultation:
- Is intended for general discussion and initial guidance
- Does not guarantee that Cultivate will accept an engagement
- Does not create an ongoing client relationship by itself
- Does not guarantee a particular business, advertising, financial, or marketing result
- May be rescheduled or canceled when reasonably necessary
Prospective clients should bring relevant questions, ideas, concerns, reports, or account information they wish to discuss. They should not share passwords or sensitive credentials through unsecured forms, email, or text messages.
Payments
Prices, billing frequency, payment terms, cancellation provisions, refund terms, advertising budgets, and third-party expenses are determined by the applicable checkout page, invoice, proposal, subscription, or written service agreement.
Unless expressly stated otherwise in writing:
- Advertising spend is separate from Cultivate’s management or consulting fees
- Third-party software and platform fees are separate
- Recurring services may be billed at the beginning of each billing period
- Failure to pay may result in the suspension of services
Intellectual Property
Unless otherwise stated, the website’s design, text, graphics, logos, brand elements, and original content are owned by or licensed to Cultivate Marketing & Consulting and are protected by applicable intellectual-property laws.
You may view and use the website for personal or internal business evaluation. You may not reproduce, distribute, modify, sell, publish, or commercially exploit website content without prior written permission.
Ownership and usage rights for client deliverables should be governed by the applicable proposal, service agreement, or statement of work. Cultivate Marketing & Consulting’s logos and brand elements may not be used without permission.
Third-Party Services
The website and Cultivate’s services may interact with third-party platforms, including:

Cultivate does not own or control these third-party platforms and cannot guarantee their continuous availability, policies, pricing, approvals, features, security, or performance. Use of third-party services may also be subject to those providers’ own terms and privacy policies.

Email & SMS Terms
Email Communications
By submitting an email address, scheduling a consultation, requesting information, or becoming a client, you authorize Cultivate to use that address for appropriate communications related to your inquiry, appointment, requested service, or client relationship.
You may unsubscribe from eligible marketing email messages using the provided method. Certain administrative or service-related communications may still be sent when permitted.
SMS Terms
By providing your telephone number and affirmatively consenting to receive messages, you agree to receive SMS or text messages from Cultivate Marketing & Consulting. Messages may include appointment confirmations, appointment reminders, responses to inquiries, follow-up messages, service updates, and client communications related to requested services.
Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe. Reply HELP for assistance. Consent to receive SMS messages is not a condition of purchase.
You must be 18 years of age or older to use this SMS service.
After replying STOP, you may receive a final message confirming that you have been unsubscribed. You may need to opt in again before receiving future SMS communications.
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to the availability and operation of participating carriers and communication platforms.
Cultivate Marketing & Consulting does not sell or share mobile information or SMS consent with third parties or affiliates for their own marketing or promotional purposes.

Disclaimers

Changes to These Terms & General Provisions
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. To the extent permitted by applicable law, any legal action or proceeding relating to these Terms or the use of this website shall be brought in the state or federal courts located in Brown County, Wisconsin, and the parties consent to the jurisdiction of those courts.
Severability
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Entire Agreement
These Terms and the Privacy Policy govern general use of the website. Any separate signed service agreement, proposal, statement of work, subscription, or invoice may contain additional terms applicable to paid services.
Changes to These Terms
Cultivate may update these Terms periodically. Changes will be reflected by revising the “Last Updated” date at the top of this page. Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
